The services provided by Kabu Experiences, owner of the website www.kabuexperiences.com, are subject to the following conditions:

General Conditions

These conditions contain certain exclusions and limitations of liability. The user acknowledges that the use of this website does not create any partnership, joint venture, agency, or employment relationship between the user and www.kabuexperiences.com.

Any booking made through this website or by any other means is subject to acceptance of these Terms and Conditions. If you do not agree with any clause, you should not proceed with the booking process. By completing a booking, the user confirms having read and accepted these Terms and Conditions. Transport

The client must contact the company directly to confirm the pick-up points for transfer services to/from the hotel or apartment.

Availability

Places for each activity are limited; advance booking is recommended. For eco-catamaran excursions, with a capacity of 50 passengers, a minimum of 15 participants is required for the excursion to take place. If the minimum number is not reached, the activity may be cancelled, offering the client the option to join the experience on another boat the same day, on a different day, or to receive a refund of the amount paid.

Timing and Punctuality

Punctuality is required. If a participant arrives after the scheduled departure time, waiting for the boat cannot be guaranteed and no refund will be provided.

Excursions have an approximate duration, depending on sea conditions and unforeseen circumstances that may arise during the trip. Kabu Experiences shall not be held liable, nor shall any claim be made, if the duration differs from that published. The same applies to charter services. Events will be subject to a contract adapted to the specific circumstances of each case.

Rates

The excursion rate includes the skipper, crew, catering, and taxes. It also includes the company’s public liability insurance.

For private charter services and events, the rate shall include what has been individually agreed with each client.

How to Book the Service

The booking form on the website must be completed and the total amount of the reservation paid through the designated payment gateway. The person completing the booking form does so on behalf of all members of the group participating in the service, thereby confirming that all participants accept the booking conditions.

This person undertakes to communicate to the other group members any information received from Kabu Experiences regarding changes, cancellations, or service conditions.

Upon receipt of the excursion booking, www.kabuexperiences.com will confirm it by email and send a numbered voucher-invoice, which must be presented to Kabu Experiences at departure. No contract shall exist with the client until payment has been confirmed.

Card Payment

Payment for the tourist activity contracted through this website must be made using a valid bank card via a secure payment gateway managed by an authorized financial institution. By completing the booking, the user declares and warrants that they are the legitimate holder of the card used or are duly authorized to use it, assuming responsibility for the accuracy and truthfulness of the data provided. Final confirmation of the booking is subject to effective authorization and verification of the payment by the issuing bank.

The client is entitled to receive the service under the agreed terms and conditions, as well as the corresponding proof of payment. The client also undertakes to comply with the specific rules of the activity, including schedules, participation requirements, and safety conditions.

The organizing company undertakes to provide the service in accordance with the description published on the website and in compliance with applicable consumer and tourism regulations, reserving the right to modify or cancel the activity due to duly justified force majeure, safety reasons, or unforeseen impossibility, in which case an equivalent alternative or the legally applicable refund will be offered.

Cancellation Policy

For any cancellation by the client, an email must be sent to hello@kabuexperiences.com including the numerical code and cancellation request.

For scheduled excursions:

  • If cancelled 24 hrs. or more before the scheduled departure time, the amount paid will be refunded. However, the company reserves the right to apply a 10% surcharge to the official price if the cancellation results in administrative costs beyond the control of the service provider.
  • If cancelled less than 24 hours before the service date, no refund will be issued.

In the event that an excursion is cancelled due to force majeure or failure to reach the minimum number of participants, Kabu Experiences will offer an alternative date and, if no agreement is reached, will refund the full amount paid.

For private charter services or events, the following conditions apply:

  • 100% refund of the amount paid if the cancellation is due to force majeure (company operational issues, sea conditions, accident, or death).
  • 90% refund if cancellation occurs 30 days or more before the departure date.
  • 50% refund if cancellation occurs between 15 and 30 days before the departure date.
  • No refund if cancellation occurs within 15 days prior to the departure date.

Changes to Conditions

Kabu Experiences reserves the right to modify these Terms and Conditions at any time without prior notice. Use of this website shall be subject to the General Conditions in force at the time of use.

Kabu Experiences also reserves the right to change service schedules at any time due to internal or external circumstances.

Liability

The client warrants that they are of legal age and have the legal capacity to contract with Kabu Experiences and to accept the obligations established by law for any liability arising from the use of this website.

The client guarantees that all personal information provided during the booking process is accurate and assumes financial responsibility for all transactions made in their name or charged to their account.

Kabu Experiences, acting in good faith, assumes no responsibility for any typographical errors or omissions on this website.

Kabu Experiences cannot guarantee that this website or emails sent are free from viruses or other potentially harmful components for your computer. Therefore, it shall not be held liable for any damages arising from the use of this website.

Kabu Experiences is the owner of this website. The use of its content for the benefit of third parties without the company’s express authorization is not permitted. All content is protected by applicable national and international copyright laws.

Any dispute shall be subject to the jurisdiction and laws of the courts of Cabo Verde.
